John Mabe is a partner in the firm's Litigation Section, where he concentrates on construction, real estate and commercial litigation. Mr. Mabe's experience in construction includes representation of owners, design professionals, general contractors and subcontractors. He applies a combination of insight, experience and advocacy in a wide array of disputes. His experience in real estate dispute resolution includes title disputes, contract dispute resolution, land use issues, administrative reviews and appeals, lease negotiation and litigation. His commercial law experience includes insurance, suretyship, wholesale distribution agreements, wholesale/retail floor plan finance, bankruptcy litigation, contracts, negotiable instruments and general civil litigation.

  • Recovered seven-figure losses incurred by developer as a result of defalcation of construction manager on five projects
  • Resolved shareholder claims arising out of ownership of closely held corporations
  • Handled lease and contract litigation for multi-state REIT
  • Worked with client and its consultants to establish record, which won development permits on appeal from adverse town council decisions influenced by public resistance to development
  • Coordinated large non-bankruptcy workout of claims against over-leveraged developer and builder
  • Handled construction and lien law disputes, including trials, appeals, mediation and arbitration
  • Handled Architect/Engineer professional liability claims, successfully recovering architect's fees and favorably resolving multi-million dollar liability claim
  • Helped large municipality gain leave to use special single-prime contracting vehicle on $30 million project, and coordinated related contract drafting, including bonding and suretyship issues
  • Worked with homebuilder to resolve over 25 homeowner claims related to alleged faulty construction practices
