Sean Sullivan is an associate in the firm's Environmental Section. His practice involves auditing and compliance counseling regarding all of the major federal environmental statutes; due diligence, contract negotiation, and permit transfers for corporate transactions; and judicial review of federal agency actions and rulemakings. Mr. Sullivan also represents clients involved in toxic tort litigation as well as CERCLA information requests, response actions, and cost recovery actions. In addition to his environmental practice, Mr. Sullivan advises waste to energy and cogeneration facilities regarding federal and state regulatory requirements and contractual issues.

- Organized and coordinated a comprehensive environmental audit for national retail chain at stores and distribution centers throughout the Southeast.
- Conducted an audit on behalf of an international manufacturing company for compliance with the Clean Water Act National Pretreatment Program.
- Provided compliance advice to two automobile manufacturers regarding EPA's mobile source program.
- Represented an automobile manufacturer regarding several investigations by EPA and the National Highway Traffic Safety Administration of environmental and safety defects.

- Sale of a self-storage business with over 200 facilities nationwide by an international holding company.
- Purchase of a ferry service in New York City by a private equity firm.
- Purchase of Seabrook Nuclear Station by FPL Energy.
- Sale of a cogeneration facility by an automobile manufacturer.
- Sale of a former construction and debris landfill to a redevelopment company, including drafting and negotiation of assignment agreements and environmental testing agreements.
- Review and revision of numerous transaction documents, including asset purchase agreements, stock purchase agreements, vendor documentation and other transactional documents.
Judicial Review
- Prepared an amicus brief to the United States Supreme Court on behalf of a national trade group in National Association of Home Builders v. EPA regarding the relevance of the Endangered Species Act to EPA approval of state NPDES programs.
- Represented industry trade group in Center for Energy and Economic Development v. EPA, challenging EPA's Regional Haze Rule for the Grand Canyon.
- Represented industry trade group in City of Waukesha v. EPA, challenging the Uranium drinking water standard.
Environmental Litigation and CERCLA
- Represented the user of an underground injection well in toxic tort litigation involving over 700 other parties.
- Represented a large manufacturing company in a common law action for property damages related to soil and groundwater contamination at one of its facilities.
- Participated in steering, technical, legal, and settlement committees for various federal and state superfund sites including the Peak Oil Site in Tampa, Florida and the Miami Airport.
Energy
- Advised the owners of cogeneration and waste to energy facilities regarding the regulatory requirements for Qualifying Facilities.
- Advised the owners of municipal waste to energy facilities of their contractual rights and obligations under various facility construction, operation, leasing, and financing agreements.
